These Terms of Service ("Terms") are an agreement between you and Paygift Inc. ("PayGift", "we", "us") for your use of the PayGift app and paygift.com (together, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms.

1. The Service

PayGift offers a cross-border shopping platform featuring U.S. brand gift cards and prepaid cards, brand promotions, membership tiers, and reward points. Brand availability, prices, and discounts may change at any time.

2. Eligibility & accounts

You must be old enough to form a binding contract in your jurisdiction to use the Service. You are responsible for activity under your account and for keeping your credentials confidential.

3. Purchases, gift cards & redemption

Gift cards and prepaid cards purchased through the Service are subject to the terms of the issuing brand, including their use, expiration, and restrictions. Except as required by applicable law or a stated policy, purchases are generally non-refundable once completed. Please verify card details and amounts before redeeming.

4. Acceptable use

You agree not to misuse the Service, including engaging in fraud, resale arbitrage, automated scraping, interfering with the Service's operation, or violating any applicable law. We may suspend or terminate accounts that breach these Terms.

5. Intellectual property & brand marks

The Service and its content belong to PayGift or its licensors. Third-party brand names and trademarks shown belong to their respective owners; PayGift is an independent platform and is not endorsed by or affiliated with those brands.

6. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

7. Limitation of liability

To the fullest extent permitted by law, PayGift is not liable for any indirect, incidental, special, or consequential damages, and our total liability is limited to the amount you paid us for the transaction giving rise to the claim.

8. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and disputes are subject to the exclusive jurisdiction of the courts located in Los Angeles County, California.

9. Changes

We may revise these Terms from time to time; material changes will be reflected by the "Last updated" date on this page. Your continued use of the Service after a change means you accept the revised Terms.
